No, the seat does not lock in the upright position. It could probably be done easily enough by a handyman, but our 3-year-old grandson has had this for a couple of years and has never pinched his fingers. But I can understand your concern.
I bought it two years ago so I do not remember 100%, but I am pretty sure it did come assembled.
A sticker on the chair says " Made in China."
